Service Policies of Menube.es

1. Scope of the Service

Menube.es provides comprehensive digital menu solutions designed for the hospitality sector (restaurants, bars, cafés, pubs, etc.). Our service operates as a “turnkey solution”, whereby the client is only required to supply the information of their menu. These policies define the extent of our obligations.

2. Services Included in the Monthly Fee

  • Web Hosting and Domain: Registration, management and annual maintenance of a personalised domain name, together with high-availability cloud hosting.
  • Initial Design and Setup: Creation of the digital menu adapted to the visual identity of the business, using Menube.es professional templates.
  • Initial Data Upload: Inclusion of all products, prices, descriptions and photographs provided by the client.
  • Full Technical Maintenance: Technical support, security, and management ensuring correct operation of the QR code and web link.
  • Content Updates: Management and implementation of changes to the menu in accordance with the Updates and Maintenance Policy section.

3. Service Fees and Billing

3.1 Sign up now, pay in February

  • The current month and the following month are provided at no cost, including delivery of the digital menu.
  • During this period, the client may verify the proper functioning of the service.
  • The initial setup fee (€250) shall only be charged if the client decides to continue with Menube.es after the trial period.
  • If the client chooses not to continue, no charges will be applied, unless they request domain transfer, which will incur an administrative fee.
  • If no transfer is requested, the domain shall remain the property of Menube.es and the service will be terminated at the end of the trial period.

3.2 Payments

  • One-off initial fee: €250, charged at the end of the trial period.
  • Monthly fee: €50, which includes maintenance, domain, hosting, and up to 8 monthly updates.
  • Annual payment (optional): A single payment with proportional refund terms.
  • Payment period: Between the 1st and 5th of each month.

4. Domain Registration and Prior Agreement

  • A domain shall be registered in the client’s name (business name) upon contracting the service.
  • To begin creation of the digital menu, the client must sign an agreement authorising Menube.es to temporarily manage the domain.
  • This agreement ensures the correct linking of the domain and allows the digital menu to be uploaded, prepared and maintained.
  • If the client discontinues the service, domain transfer is optional and may entail an administrative cost.

4.1 Domain Transfer Limitations

If domain transfer to the client is requested, such transfer does not include the digital menu, its design, its code, its internal structure or any associated development. All systems remain the exclusive property of Menube.es.

The client is granted solely a right of use while their subscription remains active. The following actions are prohibited:

  • Copying, duplicating or transferring the digital menu to another server.
  • Claiming ownership of the design, structure or software.
  • Modifying, extracting or reusing the code outside the service provided by Menube.es.

5. Suspension and Termination of the Service

  • Suspension and termination due to non-payment: If the client accumulates more than 30 days of delay in payment, Menube.es shall temporarily suspend the service. During suspension, the client shall have no access to the menu nor the ability to request updates.

    If the delay exceeds 60 days, a full termination of the service will take place, including the deletion of the domain, menu and all associated files, without prior notice to the client.
  • Client-initiated termination: The client may request termination at any time. Menube.es will proceed with:
    • Removal of the digital menu from the servers
    • Deletion of the domain registered in the name of Menube.es
    • Optional transfer of the domain subject to prior agreement

Reactivation after 60 days of non-payment:
If the client wishes to reactivate the service after full termination for non-payment (beyond 60 days), they must rejoin as a new client. This requires contracting a new subscription and paying a new one-off setup fee for the digital menu, as all previous content will have been permanently deleted.

6. Refunds and Liability Waiver

  • System failure attributable to Menube.es: entitlement to proportional refund or equivalent extension.
  • Failure caused by the client: no refunds or extensions shall be granted.
  • In the event of termination of an annual contract due to verified deficiencies in the service, the client shall have the right to a proportional refund corresponding to the unused contracted period.

7. Conditions of Use of the Digital Menu

  • Exclusive use for the client’s establishment.
  • Copying, distribution or reuse without authorisation is prohibited.
  • Menube.es is not liable for misuse by third parties.

8. Data Protection and Privacy

  • Protection of personal data in accordance with the GDPR.
  • No client or menu data will be shared without authorisation.
  • Contact and payment information is handled securely and confidentially.

9. Security and Maintenance

  • Periodic maintenance and updates to ensure security and proper functioning of the menu.
  • No liability for failures caused by third parties, internet outages, external hosting or client actions.

10. Intellectual Property Rights

  • Menube.es retains ownership of the designs, templates and software used.
  • Content provided by the client remains their property.
  • Menube.es may use anonymous examples for promotional purposes subject to prior authorisation.

11. Modifications to the Policies

  • Menube.es may modify these policies at any time.
  • Changes will be published on the website.
  • Continued use of the service constitutes acceptance of the modifications.

12. Support and Contact

  • Support available via WhatsApp, email or web form.
  • Service hours and response times will be provided to each client.

13. Optional Additional Clauses

  • Force majeure: Menube.es is not liable for natural disasters, major internet outages or failures caused by third parties.
  • Trial and guarantee policy: Current month and following month free to verify functionality.
